Inbox Agency is a brand that belongs to Future Prime Lda, headquartered at Edificio Parque Oceano, Rua Dr. José Joaquim Almeida, N. 2 – 3 E, 2780-322 Oeiras – PORTUGAL, NIF: 505 111 942, who owns a service of permission email marketing, among other activities.
In these terms and conditions, as well in all the privacy terms, the brand “Inbox Agency” substitutes the reference to the legal owner, who continues to be Future Prime Lda.
This service is provided through several websites belonging to the company.
The service of permission e-mail marketing is provided to you (hereinafter “the Subscriber”) due to the terms and conditions of this Agreement.
This document represents the complete agreement between the Subscriber and Inbox Agency.
1. SERVICE DESCRIPTION
The service of permission e-mail marketing is to send via e-mail and/or SMS, information and advertising about products and services that suits the subscriber socio-demographic profile, as long as there’s a corresponding user’s express consent.
The Subscriber is expresses his/her agreement as follows:
(A) Facilitating certain current, complete and truthful information about the Subscriber as requested by the service
(B) Maintain and update the same information to keep it complete and accurate.
The subscriber expresses the knowledge and is aware that the data he provides (the “Registration Information”) will be incorporated into an automated file and in a process to treat and manage this data.
In order to be a permission e-mail marketing service user by completing any full application form in any of Inbox Agency websites, the subscriber will bestow to Future the right to give to third parties certain information from registration on the Subscriber and its status as a user of the Service.
If any information from the Subscriber results false or inaccurate, Inbox Agency reserves the right to cancel the subscription of the Subscriber and is empowered to discontinue the rights of the Subscriber of using the Service.
The Subscriber authorizes Inbox Agency to keep and use the data of the Subscriber, with the objective of offering the subscriber other services and products from Inbox Agency and from other organizations.
The subscriber knows and is aware that the Registration Information is collected, recorded and stored in Inbox Agency servers.
The Subscriber may exercise the rights of access, rectification, cancellation and opposition regarding the processing of their personal data.
The exercise of such rights should take place through any medium that the Subscriber considers pertinent:
a) Through the unsubscribe links of cancellation of the present service in all communications sent via e-mail;

2. LIMITATION OF LIABILITY

Inbox Agency is not responsible:
for the inability to use the service
the interruption of business
for any direct or indirect, special, incidental, or consequential damages of any kind of negligence (including loss of benefits).
Inbox Agency does not guarantee:
that the service meets the requirements of the subscriber
the service is not interrupted
the service is 100% safe, timely or error free
expected results from the use of the service
the exactitude or reliability of the information obtained through the service.
the correctness of defects in the service.
The websites and emailing sent by Inbox Agency may contain links to other websites that are beyond the control of Inbox Agency and not controlled by Inbox Agency.
In case of accessing those other sites links, you must be aware that these sites could possibly ask for and collect personal data in accordance with its privacy policy, which may differ from ours.
It is also important to note that the Websites and emails sent by Inbox Agency may occasionally provide links to other sites created and managed by other organizations.
Since these sites are not owned by the Future, we cannot guarantee the quality, suitability or operation thereof, and our relationship with the said websites does not imply an endorsement of the products and or services sold or advertised, nor any information on this concerned websites.
We strongly recommend your attention and please also take into account that under no circumstances will Inbox Agency be responsible, directly or indirectly, for any damage or loss caused or alleged to be caused to you or your family members and friends regarding the use of content, goods or services available on any of these websites.
3. NO RESALE OR COMMERCIAL USE OF SERVICES
The use of the Service is only for Inbox Agency subscribers and customers (advertisers or sponsors). Subscribers, Sponsors and Advertisers agree not to give or make any commercial use of the Service without the express consent of Inbox Agency.
4. SUBSCRIBER CONDUCT
The Subscriber is the solely responsible for the content of transmissions through the Service.
The use of the service by the Subscriber is subject to local laws and regulations, districts, autonomous, national and international.
The Subscriber agrees:
Do not use the Service for illegal purposes, nor prohibited herein
Not interfere with the systems or networks connected to the service or disconnect them
Comply with all regulations, rules and procedures of the networks connected to our Permission E-mail Marketing systems.
Inbox Agency may immediately, at its sole discretion, end up the service of permission e-mail marketing with a specific subscriber, if the conduct of the subscriber is not in accordance with these terms and conditions.
5. COMPENSATION
The Subscriber agrees to compensate and exonerate from all liability Inbox Agency, its subsidiaries, affiliates, directors and employees, from any claim or proceeding, including reasonable attorneys’ fees, provided by third parties as a result of the use of Permission E-mail Marketing Service by the Subscriber, or from the present agreement violation by the Subscriber, as well as the infringement of the subscriber or other user of our Permission E-mail Marketing Service by the use of the subscriber’s computer, of intellectual, industrial or any other right of a individual person or entity.
6. MEMBERSHIP PARTICIPATION OR ADHESION
The Subscriber may maintain correspondence with the Advertisers that present their products on our Permission E-mail Marketing Service or participate in their advertising campaigns. This correspondence or participation in campaigns, including the delivery of goods and services supply and payment for them, and any other terms, conditions, warranties related to such mailings or advertising campaigns will be established only between the Subscriber and Advertiser. Inbox Agency assumes no liability, obligation or any derivative of such correspondence or participation.
7. GENERAL TERMS
This Agreement will be governed by Portuguese law, undergoing the parties to any contentious issue derived from this Agreement to the Judges and Tribunals of Lisbon (Portugal).
The titles of the clauses in this Agreement are used solely for the convenience of the parties and lack of legal or contractual significance.
8. CHANGES IN SERVICE CONDITIONS
Due to the special conditions of service, and to be able to provide the most appropriate service at every moment, Inbox Agency may change the terms and conditions of this agreement by notifying the Subscriber upon notification of changes to the site www.inboxagency.com.
The uninterrupted use of the Service of Permission Email Marketing by the Subscriber shall constitute a ratification of this document, with the modifications and changes that have been introduced.
9. SERVICE MODIFICATIONS
For the same reasons as above, Inbox Agency reserves the right to modify or discontinue the Permission E-mail Marketing Service in whole or in part, not having to send any notification to the Subscriber. Inbox Agency shall not be responsible before the Subscriber or before any third part for having exercised his right to modify or discontinue the Permission E-mail Marketing Service.
10. RELATIONSHIP CONCLUSION
Both the Subscriber and Inbox Agency will give the service finalized at any time, without prior notice, with or without reason, and such decision will be effective immediately, when one of the parties decides so.
In case of Subscriber disagreement in any of the terms and conditions of this Agreement or any of its modifications, or if the Subscriber is not satisfied with the service Permission E-mail Marketing Service, the only and suggested immediate actions are one of these:
Stop using the service;
Cancel your subscription to the Service;
Notify Inbox Agency of this Decision, trough the process described in Section 1.
Upon completion of the Service all rights of the Subscriber to use the Permission Email Marketing Service, shall immediately cease
